ACKNOWLEDGEMENT OF RISKS &
RELEASE AND WAIVER OF LIABILITY
I am aware that sportfishing/boating is an event which poses potentially serious risk of injuries or death. I am aware of the intrinsic dangers of water activities and I understand that I may be injured as a result of my negligence, the negligence of others, or through no fault of myself or anyone else, because of the nature of the activity in which I am going to be engaged. In consideration of the services of Reel Drag Fishing, LLC, their officers, agents, employees, and all other persons or entities associated with this business (hereinafter collectively referred to as “Reel Drag Fishing”), I agree as follows:
Although Reel Drag Fishing has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, Reel Drag has informed me that this activity is not without risk. The following describes some, but not all, of those risks:
· Hazards, such as water surface and subsurface conditions, adverse weather and deck conditions;
· Collisions with other objects on the boat and in the water;
· Injury from equipment to person or property;
· Hypothermia, sunstroke, heat stroke, sunburn or other conditions resulting from exposure to the elements; and,
· Encounters with wildlife.
I am aware that this activity entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those not specifically identified. My participation is voluntary and I elect to participate in spite of and with full knowledge of the inherent risks.
With the knowledge of the foregoing, and as an inducement for Reel Drag Fishing to allow me to participate in a charter trip, I hereby agree to waive or release any and all rights that I or my heirs may have to make a claim against Reel Drag Fishing, arising from any damages, injury or death which I might sustain as a result of my trip.
Further, I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.
I have carefully read, do clearly understand, and do hereby accept the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives and for all members of my family, including minor children.
Photo Release
I grant to Reel Drag Fishing, LLC, their representatives and employees the right to take photographs of me in connection with charter trips. I authorize Reel Drag Fishing, LLC, it's assigns and transferees to copyright, use and publish the same in print and/or electronically.
I agree that Reel Drag Fishing, LLC may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, marketing and web content.
Cancellation Policy
Cancellations by any customer within 72 hours of the scheduled charter will result in a full refund. The Captain reserves the right to charge a cancellation fee (loss of deposit) if cancelled by the customer within 48 hours of the scheduled charter. Cancellation by any customer within 24 hours of the scheduled charter or a no show at the dock will result in being charged the full charter fee. Any trip cancelled due to weather or "Captain's Decision" will result in rescheduling. The Captain reserves the right to make the final decision based on all circumstances regarding trip cancellations for any reason. Safety of our customers is priority number one!
